This legal notice (hereafter “Notice”) applies to all content and services offered on the website of the Fondation Hôpitaux Robert Schuman (www.fhrs.lu) (hereafter “Site”) and to any user of this Site (hereafter “User”, “you”, “your”, or “yourself”).
Acceptance of the notice
By using, accessing or visiting the Site, the User accepts and agrees to comply with the Notice.
You must read the Notice, including the documents referred to therein, carefully and in their entirety before using the Site, since the Notice constitutes a legally binding agreement between you and the Fondation Hôpitaux Robert Schuman (hereafter “the Foundation”), which defines your rights, obligations and responsibilities in your relationship with the Foundation.
By visiting the site, you accept the notice and acknowledge that you understand the information contained therein
You acknowledge that you have verified that the computer configuration you are using does not contain any viruses or other “malicious software” and that it is in perfect working order. If applicable, the Foundation cannot be considered responsible.
Publisher, host and owner
The Website www.fhrs.lu and its content are the property of the Fondation Hôpitaux Robert Schuman, whose registered office is located at 44, rue d’Anvers L-1130 Luxembourg.
The publication is managed by the Director of the Foundation, Georges Heirendt.
The Site was designed and developed by the communication agency Binsfeld, 14 Place du Parc, L-2313 Luxembourg, Luxembourg.

The Site is hosted in France by OVH, 2 rue Kellermann BP 80157. 59100 Roubaix, France.
By continuing to visit the Site, the User unreservedly accepts the following conditions.
The Foundation also reserves the right to modify the conditions of use of this Site at any time. Thus, the Foundation advises any User to regularly consult the latest version of the terms of use of the Site.

Use of the site
The User is fully and exclusively responsible for any content or information that he/she submits to the Foundation on or via the Site.
The User agrees to use the Site in a responsible manner, to refrain from infringing the rights of the Foundation or its clients and to do nothing that will cause them harm.
The User agrees, in particular, to do nothing that will harm the reputation, defame, insult, harass or threaten the Foundation, a client of the latter or a third party, and to use no device, subprogram or software that could disrupt proper functioning of the Site.
The User must refrain from submitting inaccurate, incorrect, incomplete, unreliable or misleading information.
You give a formal and express commitment to the Foundation that you will not use the Site:
- for purposes other than for your personal, non-commercial use;
- to submit any information on behalf of others or to assist others for this purpose without the prior express consent of the person for whom such information is submitted;
- for purposes that are illegal or prohibited by the Notice. In particular, you must not use the Site in any way that could damage, disable, overburden or impair the Foundation’s infrastructure;
- to engage in any criminal activity, including attempting to gain unauthorised access to any information submitted by others through the Site, computer systems or networks connected to the Foundation by hacking or any other means;
- to create derivative works incorporating any element of the Foundation, to reverse engineer or to decompose or attempt to access or modify in any way any source code of any software.
Purpose and content of the site
Information about the Foundation is of purely informative value, the purpose of which is to promote its activities to the public, and its customers.
The Foundation agrees to ensure maximum availability of said Site.
The aim is to disseminate accurate and up-to-date information from a variety of sources. However, the Foundation cannot avoid any risk of material error. None of the information published on the Foundation’s website is intended to be exhaustive or to constitute a commitment on its part. The information is not adapted to personal or specific circumstances and, therefore, cannot be considered as personal, professional or legal advice to the user.
The purposes of the www.fhrs.lu website include:
- presenting the Foundation, its activities and services, its approach, news and events;
- informing health professionals about the different services of the Foundation, including training and jobs available within the Hôpitaux Robert Schuman Group;
- informing the Foundation’s donors, notably about conditions relating to donations;
- presenting the various innovation projects that have been funded by the Foundation
- allowing Site Users to contact the Foundation
The Foundation reserves the right to correct or modify the content of the Site, at any time and without notice. You are solely responsible for the choice, use and interpretation of the data you view, query and transfer on the Site.
Languages
The www.fhrs.lu website is available in English, Luxembourgish and French, except for legal documents for which French remains the language of reference in the matter. Only the French version of said documents shall be legally binding. We make every effort to publish any information simultaneously in both languages. However, the Foundation cannot be held responsible for the unavailability of content in French or English.
Intellectual property
The Foundation is the owner, possessor or holder of any intellectual property in connection with the Site. Without being exhaustive, this notably refers to trademarks, trade names, database rights, processes, software, patents, copyrights, designs, logos, calculations, algorithms and domain names. The Foundation reserves all rights attached to said intellectual property.
Any material relating or related, directly or indirectly, to the Site is the property of the Foundation and is protected by copyright, trademark and any other laws in effect.
In particular and without prejudice to the completeness of the following list, the following are the exclusive property of the Foundation: the trademarks, service marks and logos of the Foundation and any other content and material, notably names, images, logos, software, text, graphics, data, prices, changes, tables, graphics, videos and audio (whatever their format and nature), concerning or identifying the Foundation in any form whatsoever (e.g. text, graphic, images, audio, video, HTML code, buttons, trademarks, software, logos) (hereafter “The Foundation Marks”).
You shall not authorise, permit or assist anyone with copying, reproducing, modifying, republishing, uploading, displaying, transmitting, crossing out, collecting or otherwise distributing the Foundation Marks in any form or medium, namely manually or automatically. Any use of the Marks on any other website or computer network for any other purpose is strictly prohibited. Such unauthorised use may constitute a violation of applicable intellectual property rights and, as such, may violate copyrights, trademark rights, and other applicable laws and could result in criminal or civil penalties.
As an exception to the foregoing and in the absence of any indication to the contrary, reproduction of the texts of the Site for non-commercial purposes and, in particular, in the educational context is only allowed in strict compliance with the following four (4) conditions:
- free distribution;
- respect for the integrity of the documents reproduced: no modification or alteration of any kind;
- explicit mention of the Site as a source and mention that the reproduction rights are reserved and limited;

The Foundation ensures the availability of the Site. However, the Foundation cannot be held responsible for temporary unavailability of the Site due to maintenance or improvements made to it, or for technical reasons that are not attributable to it. The Foundation reserves the right to refuse access to the Site to the User, at any time and without notice.

The Foundation cannot be held liable for the content of any of these third-party websites that you may have accessed via the Foundation’s Site
The Foundation has no means of controlling the content of these third-party sites, which remain totally independent of the Foundation
In addition, the existence of a link between the Site and a third-party site does not in any way mean that the Foundation approves the content of this site and, a fortiori, the use that could be made of it.
We seek to protect the integrity of the Site and welcome any comments on external websites to which the Site refers.
Guarantees
The Foundation’s site meets safety standards in effect. However, the Foundation cannot be held responsible for the presence of viruses or malicious software on the Site.
The Foundation makes every effort to offer Users information or tools that are available and verified, but cannot be held responsible for errors or the obsolescence of certain information. Under no circumstances can the information contained on the Site constitute a guarantee of any kind and in any field whatsoever. Cases of administrative or pedagogical errors are specified in this regard, in particular and without prejudice to exhaustiveness.
No guarantee is given as to the availability of the Site 24 hours a day, and no liability of the Foundation is assumed with regard to losses or damage resulting from unavailability of the Site.
The Foundation does not guarantee the compatibility of its site with your electronic communication equipment or installations.
Any guarantee not expressly stated in the Notice is expressly excluded.
Cancellation and suspension
At any time, without stating a reason and without resorting to use of the courts, you may decide to no longer use our Site or request to no longer receive the Site Services by sending an email to communication@fhrs.lu.
Liability
The website, its content and its components are regularly updated to allow access and use under the best conditions. However, the Foundation cannot guarantee, in real time, the timeliness, completeness, accuracy and completeness of the content of the website.
To the fullest extent permitted by law, the Foundation shall not be liable for any loss or damage resulting from a decision taken by the Foundation in accordance with “Termination and Suspension” above.
The website has been developed in a technical environment chosen by the Foundation and is regularly updated to ensure its accessibility. However, the Foundation does not guarantee permanent accessibility or the absence of errors. The liability of the Foundation is expressly excluded for all direct and indirect consequences:
- of a security breach by the user or a third party and, in general, any security breach not directly attributable to the Foundation, being limited, however, by the constraints and risks inherent to the Internet;
- of the consequences of errors and/or fraud committed by the user or a third party;
- of possible unavailability or malfunction of electronic communications systems or networks.
For reasons beyond our control, including without limitation in the event of force majeure or a change in the law.
The Foundation cannot notably be held responsible in the event of failure to update information, in the event of system manipulation or encoding errors, inaccuracies, gaps in the information provided or possible errors.
The Foundation cannot be held responsible for any harm endured, particularly given the quality of the user’s computer equipment, the quality of the Internet network and/or the technical configurations available to the user. The Foundation cannot be held responsible for a malfunction or deterioration of a module external to the website.
The Foundation will be entitled to prosecute any person who has harmed, by any means whatsoever, the website, either in its technical structure, content or components (illegal copying, hacking, sending a malicious file, etc.).
Compensation
To the fullest extent permitted by law, you expressly agree to defend, compensate and hold harmless the Foundation and its partners, including its third-party service providers or subcontractors, managers, affiliates and employees, from any action, claim, proceeding, loss, liability, damage, expense or charge (including, without limitation, any legal costs) made against, suffered by, incurred or resulting, directly or indirectly, from your access to or use of the Site or the Site Services in violation of the Notice or applicable laws.

Applicable law and jurisdiction clause
Unless expressly stated otherwise by the Foundation, no failure or delay by the Foundation in exercising any right or remedy arising out from the Notice shall be deemed as waiving any such right or remedy or any other right or remedy relating to the Notice.
No waiver by the Foundation shall be effective unless it is provided in writing.
Any notice by or to the Foundation and any notice by and to you in connection with the Site, the Site Services or the Notice must essentially be made by using the messaging system made available on the Site or by sending an email to communication@fhrs.lu. Such notification shall be considered equivalent to paper documents, including for evidentiary purposes.
The User and the Foundation may, however, also serve notification by hand, by post or by courier. In this case, any notice to the Foundation shall be served at the address below or such other address as shall be notified to you by the Foundation from time to time:

The Foundation will send any notification to you at the email address or physical address that you make available to the Foundation. Access and use of the Site, the Site Services, the Notice and the processing of your Personal Data by the Foundation are governed by the laws of the Grand Duchy of Luxembourg, excluding, to the widest extent permitted by law, any provision of Luxembourg private international law as well as any legal provision that could result in application of the law of a different jurisdiction. This is without prejudice to the protection afforded by the mandatory provisions of law which could be applicable in the absence of this paragraph.
The provisions of the preceding paragraph also apply to any dispute of a tortious nature in relation to the Site and the Site Services.
Any dispute in connection with access and use of the Site and the Site Services, or in connection, either directly or indirectly, with the Notice falls under the exclusive jurisdiction of the courts and tribunals of Luxembourg City (Grand Duchy of Luxembourg).
